General Terms and Conditions of Sale
These general terms and conditions of sale govern all relationships between the sole proprietorship Mas dâOusvan (represented by Ms. Kelly Lamy) and its customers via the website www.couleurnaturebybrunolamy.com.
They are intended to reassure each person making a purchase, as well as to protect the company against any potential abuse.
The customer acknowledges having read these general terms and conditions of sale and expressly declares their acceptance before any transaction.
Confirmation of an order constitutes full acceptance of these general terms and conditions of sale.
PRODUCT INFORMATION
Mas dâOusvan undertakes to ensure that the product ordered and received by the customer conforms to the photographs and text illustrating this product on the Website.
ORDERING VIA THE ONLINE STORE
The order represents the total number of products selected by the customer, validated at the end of the ordering process.
Special orders for a product not listed in the store:
Orders can be placed directly by phone or email. In this case, Mas d’Ousvan undertakes to send one to three photos by email to the customer once the item is completed, before the customer makes the final payment.
Payment will be made by bank transfer according to the terms and deadlines agreed upon with Kelly Lamy. Delivery times may be longer if the product has not yet been manufactured. Delivery terms remain the same as for an order placed through the online store.
ORDER CONFIRMATION
Mas d’Ousvan undertakes to confirm acceptance of the customer’s order by email, mail, or telephone.
The sale is only concluded upon receipt of this confirmation. Mas d’Ousvan reserves the right not to confirm an order (out of stock products, abnormal order, impossible delivery, previous dispute, etc.).
The customer will be informed within a reasonable timeframe, and no later than 5 business days, if the order is not confirmed.
DELIVERY
Delivery methods vary depending on the customer type:
– For individuals, deliveries are primarily made via Mondial Relay, but can also be made via Colissimo, depending on availability and options selected when ordering. Shipping is free for all orders starting from âŹ100 to mainland France or âŹ170 to Europe via Mondial Relay Pickup Point or Colissimo Pickup Point.
– For businesses, deliveries are made via DPD or ColiShip, depending on the agreements established at the time of ordering.
The delivery address provided by the customer when ordering is the definitive address. It must be complete, accurate, and comprehensible.
Mas d’Ousvan declines all liability in the event of force majeure (natural disasters, fire, strike, breakdown, etc.).
In the event of damage or missing products upon delivery, the customer must submit specific complaints to the carrier within 48 hours of receiving the package.
In the event of deliveries to multiple addresses, the customer must place as many separate orders, each subject to its own delivery costs.

Once your order has been handed over to the carrier of your choice, we will send you an email with your parcelâs delivery details.
Need to make a change or something unexpected came up? Visit the carrierâs website â your tracking number allows you to update your delivery information.
We do not deliver to: Canada, the United States, or Japan.

RIGHT OF WITHDRAWAL
The customer has 7 clear days from receipt of the items to form an opinion. In the event of an exchange or refund, the customer may return the undamaged item along with the invoice.
Cash on delivery returns are not accepted.
Product returns are made without penalty.
Return costs will be borne by the customer and must include insurance up to the market value of the package (insurance offered by La Poste).
If a customer exercises their right of withdrawal, Mas d’Ousvan is required to reimburse the amounts paid by the customer, free of charge, with the exception of return shipping costs. Reimbursement is due within a maximum of 30 days.
We may withhold reimbursement until we have received the goods back or until you have provided proof of shipment of the goods, whichever comes first.
You must return or hand over the goods to the address indicated on our Website under the “Contact” menu, namely: Mas d’Ousvan â Lieu-dit Barousse 09190 Gajan, France, without undue delay and, in any event, no later than fourteen days after you have communicated your decision to withdraw from this contract. This deadline is deemed to have been met if you return the goods before the expiry of the fourteen-day period.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature and characteristics of the goods.
The customer must return the product in its original condition and packaging.
RETURNS or EXCHANGES
 You have 30 days from the date of receipt to request a return or exchange, provided the item is new, unused, and in its original packaging.
Return shipping costs are the responsibility of the customer, unless the item is defective or there was an error in the order.
PRICES
Prices are expressed in Euros only, inclusive of VAT. VAT not applicable, Article 293B of the French General Tax Code (CGI).
Transactions are always estimated in Euros, inclusive of VAT.
The price indicated on the product sheet does not include shipping or order preparation fees.
The price indicated in the order confirmation is the final price, inclusive of VAT. This price includes the product price, handling, packaging and storage fees, and shipping costs.
For shipments outside mainland France, the customer must notify Mas d’Ousvan by email or telephone before making any payment in order to recalculate the appropriate shipping costs.
PAYMENT
The price invoiced to the customer is the price indicated by the online payment system.
Payment is made by credit card (CB, VISA, or MASTERCARD), PayPal account, or by check mailed to the following address: Mas dâOusvan â Lieu-dit Barousse, 09190 Gajan, France.
Any order paid by check will only be processed upon receipt of the payment method. Shipping times are calculated from the date of receipt of the payment method.
Checks are cashed upon order validation.
An order validated by the customer will only be considered effective once the relevant bank payment centers have given their approval or the check has been cashed.
Furthermore, Mas dâOusvan reserves the right to refuse any order from a customer with whom it has a dispute.
DISPUTES AND APPLICABLE LAW
These general terms and conditions are subject to French law.
This applies to both formal and substantive rules.
This contract is subject to French law. Mas dâOusvan cannot be held liable for damages of any kind, whether material, immaterial, or physical, that may result from improper use of the products sold.
Mas dâOusvanâs liability will, in any event, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have been substituted.
In the event of a problem in the application of this contract, and before any legal action, both parties must strive to find amicable solutions.
Complaints or disputes will always be received with attentive kindness, with good faith always being presumed in the case of those who take the trouble to explain their situation. In the event of a dispute, the customer should first contact the company to seek an amicable solution. Failing this, the Commercial Court of the department where Mas dâOusvan is located shall have sole jurisdiction, regardless of the delivery location and the payment method accepted.
WARRANTY
In all cases, the customer benefits from the legal warranty against evictions and hidden defects.
Provided the buyer can prove the hidden defect, the seller is legally obligated to repair all consequences. If the buyer takes legal action, they must do so within a “prompt” period of discovering the hidden defect.
Mas d’Ousvan guarantees the authenticity of the materials described on the product sheet.
Mas d’Ousvan declines all responsibility for the deterioration of the materials comprising the purchased product. The buyer is deemed to be familiar with the properties of the materials and therefore the risks associated with wetting, sudden temperature changes, solar and lunar radiation, and oxidation.
Following a simple request from the customer or future customer (by telephone or email), Mas d’Ousvan undertakes to respond to the customer or future customer regarding the properties and risks of the materials and their use.
RETENTION OF TITLE
Mas dâOusvan expressly reserves ownership of the delivered products until full payment of their price, including principal and interest. The mere delivery of a payment voucher does not constitute payment. The above provisions do not prevent the transfer of risks of loss or damage to the customer. In the absence of full payment, Mas dâOusvan shall be entitled to demand the return of the delivered product. Any costs incurred for this return shall be borne by the customer.
LEGAL INFORMATION
The need to have personal information collected for distance selling purposes is mandatory, as this information is essential for processing and delivering orders, issuing invoices, and providing guarantees. Failure to provide this information renders the order invalid.
INTELLECTUAL PROPERTY
All texts, comments, works, and images included on www.couleurnaturebybrunolamy.com are protected by copyright and intellectual property law worldwide.
